Terms of Use and Paid Terms

These Terms govern the free browser tools, paid subscriptions, accounts, hosted content and outputs supplied by XO3D Ltd through XO3D Labs.

Paid subscriptions are available to signed-in individuals and businesses. The advertised plan price is the final recurring price and includes VAT. Stripe may show the included VAT separately, but it is not added on top. Free browser tools may still be used for personal or commercial projects.

1. Who we are and ownership

XO3D Labs is operated by XO3D Ltd, company number 11876020, registered in England and Wales. Registered office: 1 Beauchamp Court, 10 Victors Way, Barnet, Hertfordshire, EN5 5TZ, United Kingdom. VAT number: GB 394 5800 68. Contact: [email protected].

The XO3D Labs tools, source code, page content, designs, text, structured data and branding are owned by XO3D Ltd and protected by copyright and related rights. "XO3D", "XO3D Labs" and the XO3D logo are marks of XO3D Ltd.

2. Free tools and permitted use

  • Use free features for your own personal or commercial projects.
  • Use paid features only within the plan held by the account customer.
  • Use the files and results you generate with the tools in your own work.
  • Link to any page on this site.

3. What you may not do

  • Copy, scrape, mirror, rehost or republish the tools, their source code or their content, in whole or in part, on any other site or product.
  • Reverse engineer, rebrand or redistribute a tool as your own or as part of another service.
  • Remove, hide or alter XO3D branding, attribution, copyright notices or watermarks unless your active subscription expressly includes an unbranded or white-label output for that feature.
  • Use automated systems to bulk-download or replicate the site beyond normal crawling permitted by our robots.txt.

4. Your outputs and local processing

Files you create with the tools are yours to use. Free exports may carry an XO3D Labs credit. Leave that credit in place unless your active plan expressly includes an unbranded export.

Many tools process files locally in your browser. A feature sends data to XO3D only when its action-point wording says it is hosted or cloud based. Downloads and report PDFs normally save directly in your browser. If you choose a hosted share, board, cloud-scene or embed action, the information identified at that action point is sent to XO3D to provide it.

5. Paid customer eligibility and contract formation

A paid customer must be at least 18 years old and able to enter into the contract. If you buy on behalf of an organisation, you confirm that you have authority to bind it. Individuals may buy directly without providing a company number.

The plan page, checkout and these Terms form the pre-contract information. An order is an offer to buy the selected subscription. The paid contract is formed when Stripe confirms payment and XO3D activates the subscription. The Terms version displayed and accepted during checkout applies to that order. XO3D will provide confirmation of the plan, billing interval, amount, tax treatment and renewal arrangement.

6. Prices, subscriptions and billing

  • Price and tax: public plan cards show the final recurring price in GBP including VAT. Checkout and invoices may show the VAT component separately, but it is contained within the advertised price and is not added on top. Nothing on Labs is tax advice.
  • What is included: each subscription includes only the features named in Schedule 1, on the Pro plans page and at checkout. Texture cloud is not currently available or included. Free features remain available without a subscription.
  • Account limit: one current Boards, Renderer or Labs Pro subscription can be held in the tooling group per Labs account. One current Embed subscription can be held separately. Use the Stripe Customer Portal to cancel or switch instead of creating a duplicate.
  • Renewal: monthly and yearly subscriptions renew automatically on their stated billing interval until cancelled. Stripe handles checkout and recurring payment collection.
  • Cancellation: you can request cancellation through the Stripe Customer Portal opened from your Labs account. The portal shows when cancellation takes effect and any access remaining. Cancellation stops later renewals after the effective date shown. Pro access follows the subscription status Stripe reports to Labs.
  • Failed or reversed payments: if a payment fails, remains unpaid, is reversed, refunded or disputed, paid access may be limited or removed when Stripe reports that status.
  • Consumers: consumers keep all cancellation, refund, service-quality and other rights provided by applicable law. You can cancel future renewal at any time through the Stripe Customer Portal. Any statutory cancellation or cooling-off right that applies remains unaffected.

If you believe a payment or cancellation has been handled incorrectly, email [email protected]. Nothing in these terms limits rights that cannot lawfully be limited.

Schedule 1. Paid plan inclusions

Boards Pro
Hosted Image Marker review boards, with the limits displayed on the plan page and in the service. It does not include Renderer Pro, Texture cloud or White-label Embed.
3D Renderer Pro
Unbranded 4K or 8K longest-edge still and turntable export where the browser and device support it, and cloud scene settings within the displayed limits. It does not include Boards Pro, Texture cloud or White-label Embed.
Labs Pro
Boards Pro plus 3D Renderer Pro, with each feature's stated limits. Texture cloud and White-label Embed are not included.
White-label Viewer Embed
A separate embed licence for up to 10 registered domains. It is not included with Labs Pro. Subdomain treatment is shown in the setup tool.

Schedule 2. Hosted storage and cloud features

Hosted boards, cloud scenes, share links and viewer embeds depend on server storage, a working internet connection and third-party infrastructure. Plan and service limits may restrict file size, image count, board storage, scene storage, domain count or request volume. A request can be refused when a limit is reached.

  • Boards Pro and Labs Pro: up to 200 images per board, 50 versions per image, 20,000 comments, 20,000 annotations, 500 reviewers and 2 GB of image storage per board.
  • 3D Renderer Pro and Labs Pro: up to 50 cloud scene-setting records per account, with up to 128 KB of JSON settings per record. Model and HDRI binaries are not stored in cloud scenes.
  • White-label Viewer Embed: up to 10 registered domains per account. Subdomains of a registered domain are covered automatically.

Cloud and hosted features may be interrupted for maintenance, security, abuse prevention or provider failure. No uptime or support response time is promised. Keep your own copy of important files and outputs. Labs hosted storage is not a backup service. Cancelling a subscription does not itself delete every board or record, but paid limits and features can stop applying when paid access ends.

Schedule 3. Hosted content and capability links

You retain ownership of content you upload. You grant XO3D a non-exclusive, worldwide, royalty-free licence to host, copy, process, display and transmit that content only as needed to provide, secure and support the selected hosted feature.

The Image Marker tool can create a hosted "review board". This is opt-in: it happens only when you choose to create a board. Unlike a normal share link, a board is designed to persist, so its data is stored until you delete it or an available configured retention rule applies.

  • What is stored: the images you add to the board, their versions, the annotations and comments left on them, reviewer display names, and the email address of the person who created the board. Images are stored as files on our server, not just in your browser.
  • Who can see it: only people who hold one of the board's links. Each board has three kinds of permanent link with different powers: an owner link (full control), a reviewer link (can comment), and an optional viewer link (read-only). Anyone you send a link to can use the board at that level, so treat the links as you would a password and only share the owner link with people you trust. We do not list boards publicly and they are not indexed by search engines.
  • How long it is kept: boards are kept until they are deleted or a configured retention rule applies. The board owner can choose an available retention setting or delete the board.
  • Deletion: the owner can delete a board from the board controls. Deleting a board removes its images, versions, annotations and comments from active storage. Backup copies age out under the backup cycle rather than remaining available as a live board.
  • Revoking access: the owner can regenerate the reviewer and viewer links at any time, which immediately stops the old links from working.

You confirm that you have the rights and permissions needed to upload content and invite reviewers. Do not upload unlawful, infringing, malicious or unauthorised confidential material. For a data request relating to a board that you cannot action yourself, email [email protected].

Schedule 4. Hosted Boards data processing terms

Where a business customer controls personal data placed in a hosted Board and XO3D processes it on that customer's behalf, this Schedule is intended to meet the processor terms required by Article 28 of the UK GDPR.

  • XO3D processes Board images, versions, annotations, comments, reviewer names and related service records only on the customer's documented instructions in these Terms and the customer's use of the service, unless applicable law requires otherwise.
  • Processing lasts for the paid service and the implemented Board retention period. Its purpose is to host, transmit, secure, support and delete the Board service. The people concerned may include the customer's staff, suppliers, clients and invited reviewers.
  • XO3D limits access to people who need it for the service and who are subject to appropriate confidentiality duties. XO3D uses appropriate technical and organisational measures proportionate to the service and risk.
  • The customer gives general authorisation for the service providers described in the Privacy and Cookie Notice. XO3D remains responsible for required processor terms with a sub-processor and will give reasonable notice of a material change where required.
  • Taking account of the service and information available, XO3D will reasonably assist the customer with data-subject requests, security obligations, impact assessments and regulator consultation. XO3D will tell the customer without undue delay after confirming a personal-data breach affecting that customer's Board.
  • At the end of the service, XO3D will delete or return Board personal data through the available export and deletion controls, unless applicable law requires a record to be retained. XO3D will provide information reasonably needed to demonstrate these obligations and permit a proportionate audit on reasonable notice, subject to confidentiality, security and fair cost arrangements.

The customer remains responsible for lawful instructions, notices and permissions, and must not place special-category or similarly sensitive data in a Board without first agreeing suitable safeguards with XO3D.

Schedule 5. Data exit and account changes

Download or export material you need before cancelling or requesting deletion. Cancellation does not itself delete every board or record. Feature access and paid limits may stop when paid access ends. Some records must be retained for billing, security, dispute or legal purposes. The Labs Privacy and Cookie Notice explains the categories and retention criteria.

Schedule 6. AI-named features

The live Synthetic texture mode and live Renderer assistant use rule-based, browser-side logic. They do not currently call a generative AI model. Any future network or model-backed mode must be identified at the action point before data is sent.

7. Suspension and ending access

XO3D may suspend access where reasonably necessary for security, suspected unlawful use, material breach, non-payment, abuse prevention or provider failure. Where practicable, XO3D will give notice and a reasonable opportunity to remedy the issue. Ending access does not remove rights or liabilities that arose beforehand.

8. Service standards and liability

Figures, estimates and technical guidance are indicative and should be checked against your own pipeline and project. Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or mandatory consumer rights.

For a business customer, and subject to those exclusions, neither party is liable for indirect or consequential loss or for loss of profit, revenue, goodwill or anticipated savings to the extent permitted by law. Any further financial cap must be stated in the accepted order or separately agreed terms. XO3D does not exclude the duty to perform services with the standard required by applicable law.

9. Accessibility, privacy and complaints

Read the Labs Privacy and Cookie Notice and Accessibility Statement. Send a complaint, cancellation problem or accessibility request to [email protected]. XO3D will acknowledge the message and investigate it. This process does not restrict any statutory remedy.

10. Governing law

For business customers, these Terms are governed by English law and the courts of England and Wales have exclusive jurisdiction. A consumer is not deprived of mandatory protections or any court available under applicable consumer law.

11. Changes

XO3D may update these Terms for legal, security, operational or product reasons. A new version applies to a new order only when shown and accepted. Material changes to an existing paid contract will be notified before they take effect where required.
